In pursuance of Section 35-A of the Himachal Pradesh Cooperative Societies Act, 1969, the Registrar Co-operative Societies by his order dated 10-5-1976 constituted an ad hoc committee of Salon Co-operative Agricultural Services Society. At that time the committee was constituted of five members as mentioned in. the order. The life of this committee was extended by the Government up to 9-5-1979 under sub-Sub-section (2) of Section 35-A. This was done on 19-7-1978 as per Annexure PC. Thereafter on 26-7-1978 the Registrar Co-operative Societies passed an order found at Annexure PD by virtue of which he added two more members in the committee. These two more members are (1) Shri Piara Singh and (2) Shri Salig Ram. 2. T.U. Mehta, C.J.1. In this writ application show cause notice was issued to the respondents and reply has been filed; the rejoinder has also been filed. The petitioners are the residents of Tehsil Kursog situated in Mandi District of this State. They previously belonged to Chanyana Gram Sabha which was constituted in the year 1972. This Sabha consisted of 12 villages. The petitioners, however, wanted a separate Sabha for 7 of these 12 villages. These seven villages for which they wanted a separate Sabha are Sheglinal, Badyog, D. P. F. Alyas, Kalangar, Khadkan, Kot and Sawindhar. It appears that they could persuade the Government to bifurcate the Chanyana Gram Sabha into two and to establish a separate Sabha for the above referred seven villages known as Sawindhar Gram Sabha. D.B. Lal, J.1. This appeal is brought from the judgment of the Sessions Judge, Solan in a case under Sections 363 and 366 of the I. P. Code, wherein Khyali Ram (24 years) stands charged for these offences and is convicted to five years rigorous imprisonment under each count.2. The case of the prosecution was that Khyali Ram accused, was a relation of Beli Ram and Sarla. parents of the prosecutrix Ram Pyari said to be about 18 years on the date of the offence. At village Dhundan, both the parties were residing and it is again an admitted case of the parties that Khyali Ram accused used to come and stay at the house of Beli Ram. Accordingly on 28th June, 1972 when the accused Khyali Ram was sleeping at the house of Beli Ram, in the early hours of that morning he eloped with Ram Pyari and both of them travelled on foot and came near Ghu-marwin.
