The petitioner prays for relief under Article 226 of the Constitution against an order dated November 26, 1973 of the Director, Consolidation of Holdings dismissing his petition.2. The petitioner is a resident of village Saloh, Tehsil and District Una. Pursuant to a notification under the East Punjab Holdings (Consolidation and Prevention of Fragmentation) Act, 1948, consolidation operations were commenced in the area. After the pre-partition proceedings had been published the petitioner applied on January 12, 1971, for the reservation of land for the extension of his Abadi. The application was made under Section 42 of the Act to the Director, Consolidation of Holdings. Chet Ram Thakur, J.1. In this revision petition the question which arises for decision is whether the Public Prosecutor can intervene at the stage of an enquiry under Section 202 of the Cr. P. Code, 1898, (hereinafter called the Code) in a case instituted on a complaint by a private person.2. Shri Charan Dass Dogra, an Advocate of Kulu had lodged a complaint under Sections 302, 307, 148, 149, 109, 114 and 120-B of the I. P. Code against S/Sliri Lal Chand Pararthi and five others. The judicial Magistrate in whose court the complaint was lodged took cognizance of the case as contemplated under Section 190 of the Code and he commenced an enquiry as contemplated under Section 202 of the Code. During the course of the enquiry, before processes were issued to the accused, Shri T. R. Thakur, J. 1. This R. F. A. 1 of 1965 and the cross-objections and R. F. A. 7 of 1966 arise out of a suit under the provisions of Order 34 of the Civil P. C. for the recovery of Rs. 16,000/- with costs and future interest by sale of mortgaged property described in para. 1 (g) of the plaint and further that in case the sale proceeds fall short of the amount due to the plaintiff for a personal decree to that extent or in the alternative for possession of the mortgaged property and a personal decree for interest and costs filed by the plaintiff against the defendant No. 1.2.
