ORDERD.B. Lal, J.1. Amar Nath has filed this writ petition under Article 227, wherein he has called in question the order of confiscation and sale made by the Collector of Una under Section 6-A of the Essential Commodities Act, 1955, in respect of 27 bags of maize and 19 bags of wheat said to be stored at the shop known as 'M/s. Hem Raj Rameshwar Datt'. The facts giving rise to the petition are, that the petitioner was the owner of the food stuff and the same was stored at the shop not for sale but because he needed some place to stock it. The police moved an application under Section 6-A for the confiscation of the said bags of maize and wheat. Accordingly the Collector ordered for confiscation but in addition thereto also ordered for disposal of the grain in so far as, that he directed the maize to be sold through the Food Corporation of India and the wheat to be sold by auction and the amount was to remain deposited in the Government Treasury. ORDERR.S. Pathak, C.J.1. The petitioner was appointed Office Kanungo in May 1960 against a permanent vacant post. In 1963 he was placed under suspension on account of a criminal proceeding against him. He was tried and was acquitted on March 29, 1966 by the Assistant Sessions Judge, Mahasu. Consequently the Collector, Mahasu reinstated the petitioner as Office Kanungo.2. On August 19, 1966 the Collector made an order reverting him to his substantive post of Patwari. It was pointed out that the petitioner's candidature as Kanungo had been set aside by the Financial Commissioner by his order dated December 6, 1962, and that he had not been considered for acceptance as Kanungo again and was no longer an accepted Kanungo candidate. The petitioner represented against the order before the Collector and kept on making representations in the matter. The last representation sent by him is dated September 6, 1971. This is a miscellaneous petition filed by the respondent Board of School Education praying that the petitioners should not be allowed to prosecute, and be heard in, the Supreme Court Application No. 4 of 1974 until they have purged themselves of their contempt of this Court.2. A writ petition was filed by the petitioners against the Board of School Education and others challenging the selection of certain text books for use in educational institutions in Himachal Pradesh and the rejection of the text books submitted by them. The writ petition was heard by a Full Bench of this Court and was dismissed on May 7, 1974. On June 27, 1974 the petitioners filed a petition (S. C. A. No. 4 of 1974) for a certificate from this Court to enable them to appeal to the Supreme Court.
