GOSWAMI, J. (1.) This writ appeal is directed against the order dated 3.2.1022 passed by the learned single Judge allowing the writ petition and setting aside the order of settlement dated 14.5.2010 made in favour of the present appellant by the Chairman, Sivasagar Municipal Board, respondent No 4, settling the New Market of Station Chariali under Ward No 12 for the year 2010-2011, and directing the Sivasagar Municipal Board, (for short the "Board"), to issue a fresh process of settlement of the New Market by issuing fresh tender notice. (2.) (1.) 55 number of petitioners have approached this Court by way of an application under Article 226 of the Constitution of India challenging the order dated 4.9.2009 passed by the Central Administrative Tribunal, Guwahati Bench in Original Application No. 88 of 2009, dismissing the application filed by them at the admission stage. (2.) We have heard Mr. B.D.Konwar, learned Counsel, for the petitioner and Mr. A.K.Sarkar, learned Standing Counsel, Railways appearing for the respondent Nos. 1 to 4 and as agreed to by the learned Counsel for the parties, this case is taken up for final disposal at the admission stage.
