MEHROTRA J. - A Hindu undivided family of Narsingdas Surajmal floated a limited company under the style of "Barbari Tea Estate Ltd." The tea gardens of Barbari Tea Estate were purchased by this limited concern from Rajmai Tea Co. Ltd. in 1944. This estate comprised of an area of 5,308 bighas. Subsequently, in the year 1950, the name of the Barbari Tea Estate Ltd. was changed into Jalannagar Tea Estate (Private) Ltd. - the present assessee. The area of the tea estate lies in the outskirts of the town of Dibrugarh in close proximity to the Assam Medical College. A part of the area was given over to the military for the purpose of constructing hospitals during the war. On the 15th April, 1950, the members of the joint family who had a large interest in the assessee company floated another limited company called the Jalannagar Development Co. Ltd. This is a reference by the Additional Sessions Judge (II) Manipur, made at the instance of 5 petitioners who were convicted under Sections 143 and 447, I.P.C. and sentenced to fine of Rs. 30/- each under each of the counts by the S.D.M. Thoubal.2. The case against the petitioners was that on 13.9.59 they formed themselves into an unlawful assembly with the common object of criminal trespass into the lands of the respondent, namely patta Nos. 127/50 and 127/201 and that they actually committed criminal trespass. In support of the prosecution, 6 P. Ws. were examined. The defence of the petitioner was a denial of the trespass.According to petitioners 1 to 3, the lands in dispute were their ancestral properties and had been to their possession for 12 years, while according to petitioners 4 and 5, they never entered on the lands. In this revision petition, the petitioner who is the proprietor and keeper of a Printing Press, called the Azad Printing Works in Paona Bazar, Imphal, is challenging his conviction under Section 188, I.P.C. and under Section 12 of the Press and Registration of Books Act, 1867. He was sentenced by the S.D.M., I.W. to one month's S.I. under Section 188, I.P.C. and two months' S.I. and a fine of Rs. 100/- under Section 12 of the Press and Registration of Books Act, 1867.
