JUDGEMENTG. Mehrotra, J.1. This is a revision Under Section 439 of the Criminal Procedure Code on behalf of the petitioners who are accused in a trial pending before the Sessions Judge, Lower Assam Division, Gauhati. The case was started against' the petitioners on a complaint had by the complainant opposite party Under Section 198 B of the Cr.PC on the allegation that the petitioners committed the offence of defamation against Sri Moinul Haque Choudbury, Minister to the Government of Assam in charge of Food, Agriculture, Veterinary, Co operative etc. The petitioners were summoned by the Sessions Judge Under Sections 500 and 501, Indian Penal Code. Charges were framed against the petitioner on 18th July 1959 after examining a number of witnesses. 1. The Petitioner Mahamrnad Meah has filed this application to quash the orders of the 2nd Respondent, the District Magistrate of Tripura, Annexures A and F dated 19-9-1958 and 24-12-1953 respectively directing him to leave India with his family.2. Annexure A is a notice dated 19-9-1958 in which the Petitioner was stated to be a Pakistani national and a foreigner as defined in the Foreigners Act, 1946 and he was directed to leave India within a period of one month from the date of service. The Petitioner submitted a petition to the District Magistrate Annexure B stating that he was not a foreigner, that he was born in Agartala, 16 years previously and that his father was a permanent resident of Agartala and died 15 years previously.Thereupon the District Magistrate directed Sri K. T.N.R. Tirumalpad, J.C.1. The appellant Anu Meah alias pichainna was convicted by the Sessions Judge in Criminal Session Trial No. 7 of 1960 under Section 302 I. P. C. and sentenced to imprisonment for life for the murder of one Abdul Majid. He has filed this appeal against the said conviction and sentence.2. The case against the appellant rested mainly on the evidence of P. W. 3 Safia Khatun, wife of one Sarafat Ali stated to be an eye-witness to the occurrence.
