Deka, J. 1. These are two applications for issue of certificates under Article 134(1)(c) of the Constitution of India to the effect that the cases are fit ones for appeal to the Supreme Court. The two applications are on behalf of two accused persons who were jointly tried in the Court of Session by the Sessions Judge, U. A. D. with the help of Jury. The jury returned a verdict of guilty under Section 304, Part I, read with Section 34, I. P. C. against both the accused persons. The learned Judge, however, differed with the jury as to the verdict of guilty against accused Kandura and he accordingly made a reference under Section 307 (1), Criminal P. C. to the High Court.The learned Judge expressed his view in the following words:'In view of the facts and circumstances stated above, I am of opinion that the verdict of the jury finding accused Kandura Sut guilty under Section 304, Part I, I. Rules were issued in all the four cases under Articles 226 and 227 of the Constitution of India. The petitions on which these Rules were issued are directed in each case against an order of the Excise Minister of the Government of Assam. Cases Nos. 69 and 75 arise out of the same order dated 29-5-52. The order purports to have been passed by Mr. J.J. Nichols Roy, Minister in charge of Excise, Assam, (the Excise Appellate Authority, Assam). The order in the other two cases, namely Nos. 85 and 40 of 1952 also purport to have been passed by the same Minister and in the same capacity.3. The facts giving rise to this petition are as follows:2. Messrs. Chunilal Kanhaiyalall, petitioners, owned 3 holdings in Palasbari town. We are concerned in this case with holding No. 60 in Ward No. III. The Town Committee of Palashbari constituted under Section 328, Assam Municipal Act of 1923 passed a resolution in an ordinary meeting of the committee on 26-10-1949, authorising the Chairman and Dr. Padmeswar, Goswami to revise the valuation of holdings and assessments. On 25-2-1950, the valuators submitted their valuation list and the assessment was revised. The Chairman of the Board then caused a notice dated 27-2-1950 to be published notifying the revised valuation and inviting objections to that valuation. The petitioner is one Changing Sangma and he moves this Court against the order of the Deputy Commissioner of Garo Hills passed in Revenue Appeal No.7 of 1951-52, dated 29-3-52. 2.
