K.A. Puj, J.1. The petitioners-original plaintiffs have filed this petition under Article 227 of the Constitution of India challenging the order passed by the learned Civil Judge (S.D.) Vadodara below an application Exh. 154 in Regular Civil Suit No. 774 of 1987 on 3-1-2005, on the ground that the said order is absolutely illegal, unjust, improper, irrational, invalid and unreasonable. It is also challenged on the ground that the said order is passed with total non-application of mind and on misconception of facts and law. It is further challenged on the ground that it is passed in violation of and in utter disregard of the statutory provisions of the Code of Civil Procedure and against the judicial pronouncements.2. ORDER1. Leave to amend.2. Elections to the Ambaji Gram Panchayat were held on 8-4-2007 and the results were declared on 10-4-2007. The petitioner was elected as a member of the Gram Panchayat. The Taluka Development Officer issued notice on 21-4-2007 convening the meeting of the Gram Panchayat for holding the election of Deputy Sarpanch on 30-4-2007. On 21-4-2007 itself respondent No. 3 herein filed the election petition challenging the election of Rameshbhai Ishwarbhai Rathod from ward No. 16 and on the same date, respondent No. 3 also filed application Exh. 11 for interim stay of the election of Dy.
