The petitioner, a frequent traveller between Ahmedabad and Bombay challenges the action of the respondent authorities of compulsorily collecting catering charges in the Shatabdi Express alongwith the fare while issuing the tickets for that train.2. The petitioner travelled from Ahmedabad to Bombay in Ilnd A.C. Coach of the Shatabdi Express and was charged Rs. 380/- per ticket. The petitioner had, since he did not desire to avail of the catering of food, requested the ticket issuing authority to issue the ticket excluding the catering charges. However, such option was not provided and the petitioner was compelled to purchase three tickets (one for himself and two for herself relatives) at the rate of Rs. 380/- per ticket. It is contended that the collection of catering charges was arbitrary and irrational. R.K. Abichandani, J.1. The petitioners seek a direction on the respondent Nos. I and 2. consider the application of the petitioner No. 1 dated 25-9-1995 for fixing a lumpsum amount in lieu of all or any of the taxes and in particular octroi to be paid by the petitioner No. 1 to the Panchayat and to desist from collecting any octroi until the decision is taken on that application. Similar other petitions being Special Civil Application Nos. 8782 of 1995 to 8793 of 1995 were earlier filed and were heard and disposed of on 13-10-1995 by this Court. These petitions were dismissed as premature. The respondent-contractor was under Resolution No. 16 dated 7-7-1995 passed by the Gram Panchayat given contract to collect octroi. That Resolution was temporarily stayed by the District Development Officer on 10-10-1995 and in that order the District Development Officer had also directed that octroi should not be collected until further orders were made. M.S. Shah, J.1. Heard Mr. K.S. Acharya for the Mr. S.N. Shelat, learned Advocate for the petitioner and Mr. S.N. Mazgonkar, learned Advocate for the respondent-Municipal Corporation.2. The petitioner was employed as a Junior Clerk by the respondent-Municipal Corporation. On 1st January, 1975, the petitioner was given 'acting appointment' to the post of Senior Clerk in the pay-scale of Rs. 330-560 in the Valuation Department by way of stop-gap-arrangement and on the basis of seniority of clerks in the Valuation Department. The petitioner was thereafter reverted to the lower post of Clerk on 1st April, 1976. Again Acting promotion was given to the petitioner on 1st June, 1976 and the petitioner was thereafter reverted to the lower post on 30th November, 1976. The petitioner was similarly given such ad hoc promotions on two subsequent occasions for a few months on each occasion.
