M.B. Shah, J.1. An application under the Workmen's Compensation Act, 1923 was filed by Dr. Mrs. Shobhanaben B. Dange, who pending hearing and final disposal of the said application died, for compensation contending that she was appointed by the respondents C.J. Hospital, Surendranagar, on a monthly salary of Rs. 675/- inclusive of all allowances from 25th September 1978. This Hospital was run by a public Trust named Tabibi Rahat Mandal. It was her contention that this establishment was covered under the provisions of the Bombay Shops and Establishments Act, 1948 and as per Section 38-A the provisions of the Workmen's Compensation Act would be applicable to the respondent trust establishment, It was her contention that during the course of her employment and arising out of her employment she received injuries and was suffering from disclasion or slip disc. A.S. Qureshi, J.1. In these two petitions identical question arises and hence they are both heard and disposed of by this common judgment. The petitioner in each of the petitions is the owner of agricultural land situated at the outskirts of Rajkot city. The petitioner in each of these two petitions applied for granting permission to use the land for non-agricultural purpose. The permission was granted by the Collector on 2nd February, 1970 on condition that the construction would be completed within the specified time. The Sanad was granted on 31st January, 1982. In neither case the petitioner carried out the construction as per the condition. Hence the Collector instituted a case against the petitioner in each case for contravening the condition of permission by not constructing over the land in question.2. A.M. Ahmadi, J.1. The petitioners of these two petitions are real brothers. They inherited lands bearing Survey No. 73 Part, 74/1,75, 87, 115, 117, 171/3,172 and 173 of village Mepadaand Survey No. 137 of village Mengal totally admeasuring 87 acres and 37 gunthas. Each brother had one-half share in the said lands according to the Muslim personal law by which they were admittedly governed. Therefore, each brother owned 43 acres and 38.5 gunthas of land forming part of the aforesaid revenue survey numbers.2. Both the brothers were living separately with their respective families at the relevant point of time. The petitioner Nathekhan's family consisted of himself, his wife, two minor sons, two minor daughters and a widowed mother. Petitioner Mojamkhan's family consisted of his wife, four un-married daughters and one minor son.
