ORDER1. The petitioner who was, injured in a vehicular accident has filed this petition being aggrieved by the order passed by the District Collector, Ahmedabad on 16-11-1983. Annexure 'A' to the petition, whereby he has rejected the petitioner's application dated 11th May, 1983 for being given compensation from solatium fund on the ground that he has suffered from a hit and run motor accident. The petitioner's case is that he was grievously injured by a scooterist on 11th April, 1983 at 10.30 a.m. because of which he had suffered immensely and was reduced to practically an unconscious state. Jayshree Industries took a loan from the appellant-Gujarat State Financial Corporation and pledged and hypothecated machinery and other properties with the Corporation as a security for the said loan. The amount was payable by instalments. As the respondent failed to pay the instalments as agreed, the appellant-Corporation filed Miscellaneous Civil Application No. 113 of 1977 in the District Court at Rajkot under S. 31 of the State Financial Corporations Act, 1951 (hereinafter to be referred to as 'the Act') for enforcement of its claim by attachment and sale of the pledged and hypothecated properties of the opponent Jayshree Industries. A Division Bench of this Court, while hearing a batch of petitions challenging the detention orders passed by the Central Government under the Conservation of Foreign Exchange and Prevention of Smuggling Activities Act, 1974, was called upon to consider the validity of a declaration made by the empowered officer of the Central Government under Section 9 of the said Act as amended by Ordinance No. 8 of 1984. The Ordinance substituted Section 9 of the Act by a new section. The new section reads as follows :9. These two special criminal applications were ordered to be placed before the Full Bench of this Court as it was felt that the decision rendered by the Division Bench of this Court in Spl. Cr. Application No. 756 of 1983, decided by A.M. Ahmadi & M.B. Shah, J J. on 20th June, 1983 required reconsideration in the light of a later Full Bench judgment of this Court, in the case of Nalia Jiria v. Slate of Gujarat and Ors. XXV (I) GLR 464.
