The petitioner is occupying the premises within the municipal limits of Navsari Nagarpalika, the respondent herein, and is carrying on his business of cotton ginning and manufacturing of mattresses by manual labour. His business premises had caught fire some time back. The premies required repairs. He submitted an application for granting permission for carrying out the repairs. The said application was submitted to the respondent Municipality on February 13, 1984. The respondent Municipality informed the petitioner that his application will be filed if he failed to obtain and produce the consent of the landlord for carrying out the repairs, within seven days. The aforesaid intimation was given to the petitioner on March 9, 1984. A small but interesting question arises as to when the sales tax authority exercising the powers under section 41 for making an order of assessment or exercising powers under section 44 for making an order of reassessment or for making an order of penalty under section 45 or 46 of the Gujarat Sales Tax Act, 1969 (hereinafter referred to as 'the said Act') is under obligation to make draft assessment order in this petition. The question arises on the facts and in the circumstances as narrated hereinbelow. 2. The period of assessment with which we are concerned in this petition is from 1st April, 1982 to 16th July, 1983. The respondent Koli Manu Ravji was tried by the learned Additional Sessions Judge, Bhavnagar in , Sessions Case No. 68 of 1982 for offences punishable under Sections 302, 324, 323 and 504, I. P. C. The learned Additional Sessions Judge came to the-conclusion that the accused had given knife blows to the deceased and caused his death, but while exercising his right of private defence, he had exceeded the said right and, therefore, the offence committed by him was one punishable under Section 304, Part I, I. P. C. and not under Section 302 I.P.C. He also reached a conclusion that the accused had also caused hurt to Bhagwatiben, the mother of the deceased and thereby committed an offence punishable under Section 323 I. P.C. A.S. Qureshi, J.1. This is a revision application under Section 115 of the Civil Procedure Code against the judgment of the Motor Accident Claims Tribunal for Banaskantha at Palanpur. The petitioners are the widow and two minor children of the deceased Kishanchand Ramchandani, who was killed in an accident while he was in a jeep car driven by opponent No. 1 Chelabhai Khushalbhai Rami. The accident occurred on 14th June 1975. The present petitioners filed the motor accident claim on 2nd August 1980 together with an application for condonation of delay in filing the claim.
