N.H. Bhatt. J. 1. A substantial question of law arises neatly in this second appeal, which was argued elaborately, extensively and at the same time gracefully by the learned Advocates M/s. Pandya and Vyas appearing for the appellants and the respondent respectively. 2. In order to understand the controversy at the base of this litigation, a few facts require to be neatly stated. The respondent-plaintiff was serving as a Conductor at the Veraval Depot in the year 1964 and earlier, in the time-scale of Rs. 80-160. On 20th October, 1964, he was alleged to have assaulted the Depot Manager of Veraval to which he was attached. He was then arrested by Police in connection with the said incident and 26th November, 1964 when he went to resume duty at the Depot, he was not permitted. The petitioners who are 9 in number have filed this petition with a prayer that Government resolution, dated 5-7-1982 produced at Annexure 'B' may be quashed and that appropriate writ be issued so that in pursuance of the said Government resolution no further action may be taken by the Government and its servants. Few facts which are necessary are required to be stated.2. The petitioners claimed to be the members of the Managing Committee of Khedbrahma Taluka Sahkari Kharid Vechan Sangh. From the petition it appears that there were 16 members of the Managing Committee of that co-operative society. According to the petitioners they belonged to a group which consisted of 9 members and the other group consisted of 7 members only. Opponent Nos. 1 to 6, who are original plaintiffs, filed Regular Civil Suit No. 423 of 1972 in the Court of the Civil Judge (Senior Division), Nadiad against Chandraprasad Motibhai Pandya, under Section 6 of the Specific Relief Act, 1963 (hereafter referred to as 'the Act') for recovery of possession of the suit premises. Chandraprasad died during the pendency of the suit and his heirs were brought on record. The suit was decreed; and the defendants were directed to open the door of the suit room by removing the lock and chain applied by them from inside and to hand over possession to the plaintiffs. The defendants, therefore, filed an appeal against the said judgment and decree in the Court of the District Judge, Kaira, being Regular Civil Appeal No. 16 of 1979. Desai, J. 1. The applicant in Sales Tax Reference No. 4 of 1981 (hereinafter referred to as 'the applicant-company') is a private limited company registered under the Companies Act, 1956. The applicant-company carries on the business of manufacturing and selling ferrous and non-ferrous metals at Bombay where it is registered as a dealer under the Bombay Sales Tax Act, 1959. The applicant-company is not carrying on any business and it has no place of business within the State of Gujarat. 2. The Western Railway authorities at Sabarmati in Ahmedabad, held a public auction for the sale of non-ferrous metal scrap by description through an auctioneer carrying on business at Bombay. The auction was held at Sabarmati in Ahmedabad on 13th March, 1973.
