The appellant received injuries showing fracture, dislocation, cervical 6th and 7th with complete quadriplegia with complete motor and sensory loss below the injured segment. He had, multiple abrasions over chest and shoulder. Due to injuries to the spinal cord there was paralysis below the injured level. There was paralysis of both the upper limbs and both the lower limbs, including paralysis of the front and back abdominal muscle, below the injured segment and his nervous system of the spinal cord was also affected following the injuries. He was immediately - removed to the L. G. Hospital at Maninagar but was shifted within a few hours to the V. S. Hospital. 1. The parties to this Second Appeal were married in village Sander District Mehsana according to Hindu rites, some time in the year 1961. The husband contends that they last resided together in Bhavnagar in the month of Dec. 1970 and thereafter his wife deserted him and refused to resume cohabitation. On this ground, he filed a petition No. 39/71 in the court of the learned Civil Judge, Senior Division, Bhavnagar, under Section 9 of the Hindu Marriage Act, 1955, hereinafter called 'the Act' for restitution of conjugal rights. The respondent-wife, though served with the summons of the said petition, did not enter appearance and allowed it to be disposed of ex parte. This is a case in which the claimant appellant is the injured person and the claim for compensation arose out of an accident which occurred on Dec. 6, 1971 at about 6-30 or 6-45 A. M. on the Naroda Road In Ahmedabad. The appellant, who was aged about 15 at the material time, was proceeding along the Naroda Road in the company of his sister Lila aged about 8 years with three donkeys to collect sand from the river-bed at Bhadreshwar. At that time, A. M. T. S. Bus No. G. T. A. 8495 driven by the third respondent approached from the opposite direction, that is to say, from the Sardarnagar side. . The bus hit one of the donkeys which fell down and then it collided against the appellant who was thrown down on the road and received injuries. M.K. Shah, J.1. A college student was returning after playing a cricket match, representing his college, i. e. Deesa Commerce College, against the Modasa College, by a S.T. bus from Modasa to Ahmedabad. During the course of this journey, on the 30th of September 1971, in an accident, he lost his right forearm; and these two appeals arise out of the claim petition filed in this behalf by the said claimant. When the S.T. bus in which the claimant was travelling came near Rakhial a truck bearing No. GTE 2358 came from the opposite direction. Both the vehicles were on a narrow road, asphalted portion whereof was 12' only with a kutcha strip on either side of the width of 5 ft. The claimant was sitting in the last but one rear seat of the bus resting his right arm on a window railing, and when the vehicles passed each other, his forearm was severed from the point of elbow joint and was thrown out on the road.
