These are two cross petitions against the order of the Revenue Tribunal, dated October 28, 1970, as the Revenue Tribunal has held that out of the three purchasers in the first petition, only Devji Meghji, petitioner No. 1, was an agriculturist; while the other two petitioners who had no land in this State and were not personally cultivating any land in the Gujarat State were not agriculturists. Both the parties have challenged the said decision in these two cross petitions.2. The respondents-holders in the first petition held four lands in question. The agreement of sale dated May 8, 1963, was entered into with these three purchasers for Rs. 73,551/- of which admittedly the total price of Rs. 26000 has been paid on or before May 25, 1964. A.D. Desai, J.1. The Customs Officers at Baroda and Ahmedabad received an information that a parcel containing smuggled goods was ''carried by the employee of the firm of M/s. Somabhai Kanchanlal and Co., accused No. 4 in the case, from Bombay to Ahmedabad. In total 11 parcels of the firm of accused No. 4 arrived at Ahmedabad Railway Station by Gujarat Mail on August 20, 1971. The parcels were in a break van. The parcels were received by an employee of the accused firm at Ahmedabad Railway Station at about 6.30 a.m. The parcels were then loaded in a hand-cart and taken to the office of the firm situated at Panchkuva, Ahmedabad. The Custom Officers followed the parcels keeping a watch over them. At about 9 or 9-30 a.m. the Manager of the firm of the accused at Ahmedabad was called at the office and in his presence and in the presence of two panchas the parcels were opened. Mysorewala, questions the correctness of the order dated 29th October 1975 by which she was given the benefit of the higher pay with effect from 16th July 1975 and not with effect from 1-6-1967 as prayed for by her, and for a direction directing the respondents to pay the arrears of salary which would be payable to her once she is put in the scale of Rs. 200-340 from 1-6-1967.2. N.H. Bhatt, J.1. This second appeal arises out of execution proceedings. The appellants are heirs of the original judgment debtor against whom a decree of eviction from rented premises had come to be passed for the first time by the High Court in Second Appeal No 589 of 1965 decided by this High Court on 25-3-71. Lavji Ragnath, the husband of the respondent had filed the said suit for possession of the rented premises under the provisions of the Saurashtra Rent Act and the ground of eviction was non-payment of rent. Both the trial court and the appellate court, namely, the District Court, had dismissed the plaintiff's suit against which the above-mentioned Second Appeal had come to be filed in the High Court in the year 1965, as the number indicates. During the pendency of the said Second Appeal, said Lavji Ragnath died on 3-4-68, but the High Court and the respondents in the High Court did not know of the death of the sole appellant before the High Court.
