B.J. Divan, J.1. The petitioner in this Civil Revision Application is the State of Gujarat. The first opponent is the original plaintiff No. 2 and opponents Nos. 2 and 3 are the original defendants Nos. 1 and 2. This Civil Revision Application arises under the following circumstances. One Chandramani and the present first opponent filed a suit in the Court of the Civil Judge, Sr. Dn., Palanpur. The suit was filed as a representative suit by the plaintiffs on behalf of themselves and on behalf of the Vadnagar Nagar Community of Petlad for possession of a shop and for accounts in respect of the rents received and for mesne profits and costs. The first defendant was the Maharaja of Danta, in his capacity as the ruling prince of Danta. The second defendant was also the Maharaja in his capacity as the Administrator of the Joint Hindu Family of which he was alleged to be the Karta. N.G. Shelat, J.1. This application in revision arises out of an order passed on 30th June 1965 by Mr. S.C. Bhatt, Judicial Magistrate, First Class, Vijapur, in Summary Case No. 414 of 1965, whereby the accused-applicant came to be convicted and sentenced to pay a fine of Rs. 10/- or, in default, to suffer simple imprisonment for three days for an offence under Section 179 of the Indian Penal Code.2. The facts of the case are quite simple. One application Ex. 7 purported to have been signed by four persons including Babulal Chhaganlal, the accused-applicant, was received by the Hon'ble Home Minister of the State of Gujarat, Ahmedabad, and the copies thereof were sent to the D.S.P. District Mehsana, as also to the Hon'ble Minister for Agriculture, State of Gujarat at Ahmedabad. That application was then forwarded by the Home and Civil Supplies Department to the D.S.P.
