1. This appeal is directed as against the order dated 23.3.2006 in ASA-31/2006 passed by the DRT, Bangalore.2. The appellant had borrowed a loan payable over a period of 180 months. Though the appellant had repaid some amount, he was not able to pay the instalments in time. Hence the Bank had issued a demand notice under Section 13(2) of the SRFAESI Act on 15.11.2003, and taken possession of the property on 14.12.2004 and a sale notice was issued on 24.11.2005, and the sale was held on 13.2.2006, and sale certificate was also issued on 27.2.2006 As against the measures taken by the respondent Bank the appellant preferred an application/ appeal before the DRT, Bangalore, in ASA-31/2006 questioning the validity of the measures taken by the Authorised Officer and his application was dismissed aggrieved by the same, this appeal has been filed.I have heard the learned Advocates for the appellant and the respondent.3. 1. The Miscellaneous Appeal is directed as against the order dated 17.5.2006 passed by the DRT-II at Chennai.2. The learned Advocate for the appellant submitted that the 1st respondent Bank brought the subject item of the property along with other property for sale under the SRFAESI Act in the auction fixed on 15.3.2006, and the appellant expressed his willingness to participate in the auction and also given a letter to the Authorised Officer of the respondent Bank on 14.3.2006, along with a Demand Draft dated 14.3.2006, for a sum of Rs. 6,50,000/- being 10% of the E.M.D. in respect of Item-1 of the property alone. 1. This Miscellaneous Appeal is directed against the Order dated 24.3.2006 passed in MA-134/2003 I OA-1639/ 1998 by the DRT-I at Chennai. The defendants in the OA are the appellants. The OA filed by the respondent Bank was decreed ex parte on 13.7.1999. The defendants 1, 2 and 4 have filed an application to set aside the ex parte order and also to condone the delay in filing the appeal and for stay.
