They have been filed under Section 260A of the Income Tax Act, 1961, hereinafter referred to as “the Act”. 2. The challenge by means of this Regular First Appeal filed under Section 96 of the Code of Civil Procedure, 1908 (CPC) is to the impugned judgment of the trial Court dated 23.9.2011 decreeing the suit of the respondent/plaintiff filed under Order 37 CPC by dismissing the leave to defend application filed by the appellant/defendant. 2. A reading of the plaint shows that the suit has been filed on the basis of a cheque for Rs. 3 lacs dated 3.11.2008 which was dishonoured.
