1. The applicant submitted WP(C) No 4928/2008 in Honble Delhi High Court praying that ACR for the period 01/09/02 to 31/08/03 be set aside and he be considered for promotion afresh to the rank of Brigadier. The application was transferred to the AFT on 11/08/09. 2. The applicant was commissioned in the Indian Army on 24/12/82. He was promoted Colonel and assumed command of 92 Medium Regiment in July 2002 at Partapur, Ladakh. 3. At Partapur his regiment was given responsibility to look after Gurudawara, Regimental Institution of 14 Corps located 30 Kms from Leh. He was ordered to carry out certain alteration/improvements on the order of HQ 14 Corps and HQ 3 Infantry Division. In compliance he despatched certain operational works stores for this purpose. The vehicle carrying these stores was however stopped 30 Kms short of the Gurudawara and a Military Police report was initiated against his unit on 24/07/03 (Annexure P-3). 4.
