These appeals relate to the assessment year 1996-97 and 1997-98 and arise out of the common order dated 10-8-2007 passed by the Income-tax Appellate Tribunal in ITA Nos. 4562 and 4563/Delhi/2004 in respect of assessment years 1996-97 and 1997-98, respectively. Since identical issues are raised in these appeals, they are being disposed of by this common order.4. The original assessments were completed on 30-3-1999 and 29-3-2000 under Section 143(3) of the Income-tax Act, 1961 in respect of the assessment years 1996-97 and 1997-98, respectively. A search was conducted on 29-8-1996 under Section 132 of the said Act and the audit report was also received by the Assessing Officer under Section 142(2A). Kailash Gambhir, J.1. The appellant D.T.C. feeling aggrieved with the award dated 2.1.2004 passed by Motor Accidents Claims Tribunal has preferred the present appeals, viz., M.A.C. Appeal Nos. 277, 279 and 283 of 2004. Since the appeals arise out of the common award, therefore, the same are being disposed of by this common order.2. The facts of the case in a nutshell are as follows:On 13.11.1999 at about 11.45 a.m., Suresh Kumar Deshwar along with his wife, Neelam Deshwar, their daughters Pooja and Somya and his uncle, Jiya Lal were going in a Maruti car bearing registration No. UP 16-6468, which was being driven by Suresh Kumar Deshwar at a slow speed and on the correct side of the road from Delhi to Muzaffarnagar.
