This is a revision petition made under the Provisions of Sections 397 and 401 read with Section 482 of the Code of Criminal Procedure for setting aside the impugned order dated 29th November, 2003 passed by the Metropolitan Magistrate in a complaint case No. 206/1/95 for commission of offence punishable under Section 304-A IPC.2. Vide impugned order the Metropolitan Magistrate had recalled the summoning order made earlier against the petitioner a Doctor by profession and D.M. in Neurology.3. Thereafter, the petitioner passed secondary examination in 1994. According to Service Rules a Class IV (Group D) employee is eligible to be promoted to the post of LDC or Salesman-III, Class III (Group C) post provided he has passed the metriculation or equivalent examination from a recognised Board or University and has also to his credit the three years of completed service in Group D post. The learned Counsel for the petitioner submits that the petitioner is aggrieved by the order dated 31.07.2006 whereby the learned Metropolitan Magistrate has directed that the case be tried by the court of Sessions. He points out that hitherto the matter was being tried by the Magistrate's Court.
