Puja International and its partners and remaining appeal No. C/2344/91-A is filed by the department against the common impugned order dt. 19-6-1990 passed by the Additional Collector of Customs, New Delhi.2. The assessee, a firm, carrying on the business of jewellery has filed this appeal and has raised the issue of liability of loss of Rs. 36 lakhs worth of jewellery which were stolen from the shop and some minor issues like disallowance of car expenses for personal usage and non-allowing of deduction for donation.2. Shri C. S. Aggarwal, learned counsel for the assessee, submitted that the shop of the assessee which is located in the busy business area of Chandni Chowk at Dariba Kalan, was broken into by some miscreants on the night of February 1, 1981, which was brought to the notice of the partners of the firm on the next morning when some passers-by saw the locks of the shop broken and the shutters of the shop slightly open. The police were called and an inventory of the stocks was also taken. ORDER1. M/s. Caprihans India Ltd. filed a petition for winding up against M/s. Mey's Pharmaceutical Pvt. Ltd. (hereinafter called the company), under Ss. 433, 434 read with S.439 of the Companies Act, 1956 (hereinafter called the Act). Facts in brief are that the petitioner is carrying on business of manufacturing and supplying of Sunblis Thermoforming Foils which is used in pharmaceutical trade. The company placed order for the supply of Sunblis Rigid PVC Thermoforming Foil of different specifications to the petitioner. Petitioner supplied the material as ordered and raised various invoices of the company for payment amounting to Rs. 48,815.95 P. The company in response to those three invoices issued three cheques bearing No. 037276 dated 22-7-90 for Rs. 21,526.03 P., drawn on Allahabad Bank and cheques Nos. 037398 and 037465 dated 30-8-90 and 1-11-90 for Rs. 7,687.87 P. and Rs. 3,000/- respectively, drawn on the same bank. Anil Dev Singh, J.(1) The facts leading to this petition are as under:- the petitioner, which is a Private Limited Company, filed an application on June 13, 1959 for the grant of a prospecting license for Lime Stone and dolomite over an area of 6 sq. miles in village Gosguda Sunder Garh, District(Orissa). This application remained pending with the State Government without any tangible result. Under Rule 11 of the Mineral Concession Rules, 1960 (tor short 'Rules') the State Government was required to dispose of the application within a period of 12 months, failing which it was to be deemed to have been rejected. The petitioner filed a revision petition before the Central Government which was also rejected on March 17, 1962.This order of the Central Government was successfully challenged by the petitioner in a writ petition preferred before this Court. However, by a separate order passed on the same day, the learned Metropolitan Magistrate submitted the proceedings, and forwarded the petitioner to the Chief Metropolitan Magistrate holding that he ought to receive a punishment more sever than that which he was empowered to inflict. Aggrieved by it, the petitioner preferred an appeal before the Court of Sessions.
