(1) This appeal is again it the acquittal recorded by Additional Sessions Judge, Delhi, on 8-5-85 in favor of the respondent under Section 7/16 of the Prevention of Food Adulteration Act (for short Pfa Act). Earlier, learned Metropolitan Magistrate by his order dated 12-6-84 had found the respondent guilty and had sentenced him to undergo imprisonment for one year and a fine of Rs. 5000.00 In default of payment of the fine, the respondent had to undergo simple imprisonment for five months.(2) The field staff Delhi Administration on 14-10-82 at 2.30 p.m. had lifted a sample of 'Suji' from the premises of M/s. Aggarwal Provisions Store, B-69/1, Main Market, Bhajan Pura, Delhi. The sample was sold by Dinesh Kumar respondent to Public Witness 3 Gian Chand, Food Inspector. Mahinder Narain, J.(1) This is a wife's appeal against the order passed by Shri Rc Jain, District Judge, Delhi on 23rd March, 1984. The Additional District Judge has dissolved the marriage between the parties by granting divorce under Section 13(1)(ia) and (ib) of the Hindu Marriage Act (hereinafter called 'the Act'). 1. These appeals are directed against two Orders-in-original passed by the Collector of Customs and Central Excise, Chandigarh. One order, viz. No. 18/Cus/83 dated 3.10.1983 was passed by the Collector under the Customs Act, 1962 and the other order, viz. No. 4/Gold/83 dated 3.10.1983 was passed under the Gold (Control) Act, 1968. By the Order-in-Original passed under the Customs Act, the Collector absolutely confiscated the seized 10 gold bars of 10 tolas each weighing 100 tolas under Section 111 of the Customs Act and imposed a penalty of 20,000/- under Section 112 of the Act. Under the said order he confiscated the seized Indian currency of Rs. 5200/- under Section 121 of the Customs Act and 3 rubberised knee caps under Section 119 ibid. (1) Both these appeals arise out of judgment dated 17th December 1984 of Rent Control Tribunal directing eviction of the appellant-tenant on the grounds under Clauses (a) and (e) of the proviso to Section 14 of the Delhi Rent Control Act (hereinafter referred to as 'the Act'). (1) The appellant Miss Manju Groyer (hereinafter for short known as Manju) was charged by the Additional Sessions Judge Delhi, under Section 302 Indian Penal Code for committing murder of one Bhagwanti Grover. She was found guilty and was convicted and sentenced to undergo imprisonment for life. Aggrieved with this order she has filed this appeal. (2) The dispute is in respect of property No. WZ-40,PhoolBagb, Rohtak Road, Delhi. These premises were admittedly let out by Naurattan Chand to Harbans Lal on a monthly rent of Rs. 425.00 vide lease deed dated August 22, 1966. The tenant, admittedly, sub let a part of the premises to the present appellant (M/s. Namdhari Body Builders). The landlord, it appears, took objection to the sub letting and served a notice on the tenant in this behalf. A compromise was arrived at between the landlord and the tenant on April 1, 1970.
