These references have been made by the Tribunal at the instance of the Commissioner of Income-tax, New Delhi. The assessed-respondent in the Income-tax Reference Nos. 136 to 138 of 1977 is the Eternal Science of Man's Society, New Delhi, and the assessment years are 1970-71, 1971-72 and 1972-73. In Income-tax References Nos. 219 to 221 of 1977, the assessed-respondent is M/s. Daulat Ram Public Mission, New Delhi, and the assessment years are 1970-71, 1971-72 and 1972-73. M/s. Sachar, J.(1) This judgment would dispose of Civil Revision Nos. 798/78, 558/78 and 219/79 as common question of law is involved in them.(2) This matter was admitted to a Division Bench by one of us (Sachar J) because there was a conflict of view between two learned Single Judges of this Court as to whether Section 7(v) of the Court Fees Act, 1870 or Section 7(xi)(cc) of the said Act applies in a suit filed by owner of the house for possession of the premises on the ground that the tenant whose tenancy had been terminated during his life time had died and the premises are now in occupation of his heirs.(3) The respondent No. 1 has filed a suit claiming that the premises were in the tenancy of one Ram Sunder Bhatia whose tanancy was terminated by notice dated 6th January, 1958. Kirpal, J.(1) In this petition under article 227 of the Constitution the petitioners-tenants are challenging the order dated 12th March, 1975 passed under section 19(l)(a) of the Slum Areas (Improvement & Clearance) Act, 1956, whereby permission to file eviction petition was granted to the respondents No, 2 and 3. (2) The petitioners are tenants under the respondents No. 2 and 3 of the Barsati of the second floor of the house bearing No. 1368, Kucha Ustad Hamid, Bazar Gulian, New Dariba, Delhi on a monthly rent of Rs. 34.00 . Rajinder Sachar, J.(1) This is an appeal against the order of the Rent Control Tribunal by which he set aside the order of the Rent Controller and directed the respondent/tenant to pay the arrears of rent @ Rs. 18.00 per month w.e.f. 13/11/1969. The Rent Controller had directed the payment of arrears @ Rs. 50.00 per mensern.(2) The petitioner/landlord has filed an eviction petition on the ground of nonpayment of arrears of rent under clause (a) of proviso to sub-section (1) of section 14 of the Delhi Rent Control Act (to be culled the Act). The landlord who had purchased his property from the custodian had been given the sale certificate in 1964. He moved application for fixation of.standard rent. The Rent Controller by an order of 22/9/1966 fixed Rs. 50.00 per mensern as the standard rent. That order was sought to be set aside by the tenant but he failed before the Rent Control Tribunal. Sultan Singh, J.(1) This judgment will dispose of three appeals, namely, S.A.O. Nos. 138, 139 and 140 of 1979 by three different tenants against their landlady Smt. Gayatri Devi in whose favor the contraller and the Rent Control Tribunal passed an order of eviction on the ground covered by clause (h) of the proviso to sub-section (1) of section 14 of the Delhi Rent Control Act, 1958 (hereinafter called 'the Act') against all the three appellants. The accused has preferred the present petition u/s 482 of the Code of Criminal Procedure for the said proceeding8 being quashed. The one simple question arising in the case is whether the Magistrate has any jurisdiction to proceed against the accused because the prosecution undertaken by the Magistrate was never sanctioned by the District Magistrate as required by section 39 of the Arms Act, 1959.
