Jain, J.(1) The Respondent who is the landlord filed an eviction petition against the appellant who is the tenant before the Controller under Clause (a) of the proviso to Sub-section (1) of S. 14 of the Delhi Rent Control Act, 1958 (hereinafter the Act). The petitioner lamented that the occupant was introduced into the premises as a licensee but later on he refused to vacate the premises and claimed that he was a tenant at Rs. 200.00 per month, since March 1, 1974. The respondent succumbed to this stand and filed a petition for eviction on the ground of non-payment of rent and an order under Sub-section (1) ofS. 15 of the Act was passed on March 7, 1977, directing the appellant to deposit arrears of rent within one month. The respondent complied, though he also filed an appeal which he lost on March 1, 1978. (2) The tenant defaulted again in the payment of rent since May 1, 1977. Sultan Singh, J.(1) The question for decision is : 'WHETHERan appeal lies under clause X of the Letters Patent from the judgment of a learned single Judge of this Court condoning delay in filing the first appeal from the order of the Subordinate Judge with powers to grant succession certificate.'(2) This judgment will dispose of two appeals L.P.A. Nos. 39 and 40 of 1980. (3) The relevant facts are: Ram Parkash Sharma died on January 9, 1976, and his widow Chanan Devi applied for the grant of succession certificate. This petition was being prosecuted by Amar Parkash Sharma as her next friend because she was considered to be of unsound mind and a lubatic lodged in the mental hospital Shahdara and Amar Parkash Sharma was appointed as Manager of the assets of the deceased by order dated October 5, 1976 of the District & Sessions Judge, Delhi. Lathra, J.(1) The present Petition under Section 482 of the Code of Criminal Procedure, invoking inherent jurisdiction of this Court, is against an order dated 7th December 1979 of Shri Ravi Kumar, Chief Metropolitan Magistrate, Delhi directing that a charge be framed against the present petitioner in respect of commission of offences punishable under Section 406 and 420 Indian Penal Code. 11th January 1980 was fixed for framing of the formal charge on which date charge was framed by Shri K. P. Verma, then Chief Metropolitan Magistrate, Delhi and the case was fixed for prosecution evidence. (2) The prosecution was started on account of acomplaint in writing of Shri Bishashar Nath dated 21st September 1975 on the basis of which F.I. R. was recorded on September 22, 1975.
