The respondent-firm is doing the business of wholesale and retail distribution of general merchandise including sugar. It is registered as a dealer. For the year 1965-66, the respondent filed its return of turnover on examination of which it was called upon to prepare a list of sales of icing sugar. A statement was prepared on 30th December, 1967. According to that statement, the dealer had sold icing sugar locally to the tune of Rs. 2,396.45 during the assessment year. The dealer had contended that the sales of sugar were exempt from taxation, as sugar fell under entry No. 9 of the Second Schedule to the Bengal Finance (Sales Tax) Act, 1941, as extended to the Union Territory of Delhi. The Sales Tax Officer, however, took the view that as starch was mixed with icing sugar it became a different commodity and the sales attracted taxation at 5 per cent. Municipal Corporation of Delhi (Corporation), respondent No. 1, is a statutory body constituted under the Delhi Municipal Corporation Act, 1957 (the Act). According to the rules and bye-laws of the Corporation a building plan accompanying an application for sanction to build has to be prepared by a draftsman licensed by the Corporation. The appellant, thereforee obtained a license from the Corporation. The license which had been granted to the appellant in the month of March 1962, was in force up to the end of September 1962. IN1962 the appellant submitted plans for the construction of a church on behalf of Delhi Diocesan Trust Association, Delhi. These plans were rejected. Leila Seth, J. (1) This appeal is directed against the order of Shri Mohinder Pal, Sub-Judge 1st Class, Delhi, dated 27th February 1976. (2) The case brings within its compass two families. The family of Beej Raj and the family of Devi Sahai. Ram Sahai Mal and Meena Ram were sons of Beej Raj. There was another son Bhagirath Mal who died earlier. Bhagirath Mal's sons are Rameshwar Dayal and Hira Lal. During the pendency of the proceedings, the elder brother Ram Sahai Mal also died and his heirs and legal representatives were made parties. Avadh Behari Rohatgi, J.(1) On September 28, 1963, a house bearing No. 1349 situated in Gali Khan Khannawali, Phatak Habash Khan, Delhi collapsed. The adjoining property was house No. 1334. Some of the debris of house No. 1349 fell on property No. 1334. As a result the ceiling and some portions of property No. 1334 also caved in. The wife of the plaintiff-respondent Ramesh Chander was buried in the malba of property No. 1349 and 1334. She was a young women of 24. The fire brigade was immediately called. After great efforts the dead body of the plaintiff's wife was taken out. (2) The plaintiff was tenant in house No. 1334. As a result of this catastrophe he sustained great loss. His wife died. His movables were damaged. (3) On January 14, 1964, after serving notice on the Union of India and the Municipal Corporation of Delhi Ramesh Chander brought a suit against them in forma paupris to recover Rs. 25,000 for the damage he had suffered. Suit No. 507 of 1968 was for maintenance from 13.5.1963 to 31-3-1966 and Suit No. 148 of 1967 was for maintenance from 1.4.1966 to 31.12.1970. The two suits were decided together by the learned single Judge who awarded maintenance to the wife at the rate of Rs. 300.00 per month till the 31st December, 1,970 and Rs. 450.00 thereafter from January, 1971.
