1. Sawai Man Singh, the erstwhile Maharaja of Jaipur, was adopted on 24-3-1921 and he ascended the Gaddi on 7-9-1922. He died on 24-6-1970.He ruled the Jaipur State as the Maharaja of Jaipur till 1947. With the independence of India, the Paramountancy lapsed. Thereafter, the State of Jaipur acceded to India by instrument of accession (date not given by the parties) and thereafter merged in the United State of Rajasthan on 30-3-1949. The covenant with the Government of India is dated 6-12-1949, which recognised the terms of accession under the terms of accession/covenants. The properties of Jaipur State, of which the Maharaja of Jaipur was the absolute owner up to the merger, were divided into two categories being State properties and private properties. Up to the assessment year 1969-70, the late Maharaja filed his returns of income in the status of an individual. Sachar, J.(1) This is an appeal against the order of the learned single Judge since reported in : AIR1978Delhi35 by which he held that the respondent is entitled to Rs. 11,10,780 as claimed by it in the execution petition and interest from the date of the execution petition till the payment (r) 6 per cent. (1) To encourage tourist transport in India, section 63(7) of the Motor Vehicles Act, 1939 has been inserted in the Act to provide for the issue of permits in respect of tourist vehicles. In view of the growing importance of tourist traffic the ascertainment of the scope of the permit issued for a tourist vehicle has become important. It is this question which arises in this writ petition.(2) The petitioner is the holder of a permit valid for the States of India mentioned therein in respect of a tourist vehicle plied by him. The permit has been issued to him by the State of Nagaland in 1979 under section 23(7) of the Motor Vehicles Act. The petitioner is, however, plying the vehicle between Delhi and Agra and Delhi and Jaipur, but not between Nagaland and Delhi and vice-versa. Tewari, Metropolitan Magistrate vide his judgment dated 19th March, 1977 and was sentenced to a fine of Rs. 500 in default he was awarded simple imprisonment for two months. The relevant assessment years are 1962-63 and 1963-64 for which the corresponding previous years ended on the 31st October preceding.2. In the proceedings for assessment for these two years, the assessed claimed that the surplus realised by it on purchases and sales of shares effected during the accounting years should be treated as its income from business. The ITO repelled this contention and held that the surplus was chargeable under the head 'Income from other sources'. A contract was entered into between the Committee and the contractor for construction of a Five Star Hotel now named as Akbar Hotel at Chanakyapuri, New Delhi. That contract was reduced into writing. Vide that agreement, the construction was to be started by 30th November 1966 and was to be completed by 28th February 1969.
