This is a somewhat unusual case where public issues instead of being debated objectively by the public representatives and in a calm atmosphere of chamber have been made the subject matter of challenge and counter challenge with further consequences possibly not anticipated even by the participants.2. These are two writ petitions by voters of different wards of the Municipal Corporation of Delhi seeking a writ of quo warrant to for a declaration that the two municipal councilors. Shri Bhagwan Dass Verma (Respondent No.3 in Writ Petition No.1130/72 and respondent No.5 in Writ Petition No.1263/72) who had resigned their seats are not entitled to continue as councilors and that their seats be declared vacant. P.S. Safeer, J.(1) This petition impugns the order passed by the trial Magistrate on 29.7.1972 with which the Additional Sessions Judge declined to intefere. (2) The petitioner had submitted to the Court the sample given to him on 14.1.1972 by Shri R. P. Singh, Food Inspector who sampled the purchased commodity and the trial Magistrate had to exercise his jurisdiction within the scope of section 13(2) of the Prevention of Food Adulteration Act 1954, hereafter called 'the Act.' (3) He was to ascertain that the marks and seals and the fastening were so intact as to affirm that the sample produced had not been interfered with. The Court directed that Shri R.P.Singh. Food Inspector be sent for. The statement of the said Food Inspector was recorded on 29.7.1972 wherein he stated the bottle produced by the accused had not been tampered with and the seals were intact. 1. The suit of the respondent No.1 landlord for appears of rent against his tenant Banarsi Das was decreed by Sub-Judge, First Class, Delhi. During the pendency of the first appeal filed by Banarsi Das, the said Banarsi Das died on 15-07-1968. One of his legal representatives, namely, his son Shri Ram, made an application on 23-11-1968 for being brought on record as the legal representative of the deceased. This application was deliberately vague. It did not even mention the date of the death of Banarsi Das. As it was filed beyond the prescribed period of limitation, no action could be taken on it. On 7-12-1968 another application was made by two other legal representatives, namely Shri Dhani Ram and Smt.
