Jagjit Singh, J.(1) A suit brought by Messrs K. C. Madanlal & Co., Sadar Bazar, Delhi, a registered partnership firm through its partner Kapur Chand Jain, for recovering Rs. 780.00 from the Jullundur Ex-Servicemen Motor Transport Co-operative Society Limited Jullundur (hereinafter referred to as the Transport Company) and Messrs Beauty Palace, Hoshiarpur (respondents I and 2) was dismissed by Shri A.N. Aggarwal, Adeitional Juage Small Cause Court. Against the order of Shri Aggarwal the plaintiff-firm filed the present revision, under section 25 of the Provincial Small Cause Court Act. (2) I he facts cf the case are very simple. Messrs K. C. (1) This petition has been filed by two of the ex-Directors of Messers Auto Link Financiers Private Ltd. under section 633(2) of the Companies Act, 1955 praying that they may not be prosecuted under section 614-A (2) of the said Act for their failure to comply with the directions of the Sub Divisional Magistrate, Darya Ganj, Delhi. (2) It appears that the company had failed to comply with the requirements of sections 159, 166, 210 and 220 of the said Act for the years 1965, 1966 and 1967 and its Directors were prosecuted for not filing the balance-sheets as at November 30, 1965. The trial was in the Court of Miss K. Roy, Magistrate 1st Class,. New Delhi. Deshpande, J.(1) We have to construe sub-sections (1) and (4) of section 19 of the Slum Areas (Improvement & Clearance) Act, 1956 (hereinafter called the Act) after taking into. account the legislative context of such construction. The premises occupied by the petitioners in this and the connected writ petitions as tenants were formerly evacuee property and, thereforee, rents payable by these temants are very low, namely Rs. 2.50, Rs. 5.00 and Rs. 3.50 per month in Writ Petitions 911, 912 and 913 of 1969 rspectively. The evacuee property was later acquired by the Government under Section 12 of the Displaced Persons (Compensation & Rehabilitation) Act, 1954 and sold to one Smt. Sarla Gupta by public auction. This reference under Section 66(1) of the Income-tax Act, 1922, has been made by the Income-tax Appellate Tribunal (Delhi Bench ' C ') on being moved by the assessed which is a private limited company. The assessment year concerned is 1958-59, the relevant financial year being 1957-58.2. The facts leading up to this reference are that the assessed-company purchased 825 bales of staple fibres from a manufacturer in Japan during the accounting year 1952-53 for a total-sum of Rs. 10,15,894. The entire cost of this staple fibres purchased by the assessed was met by the Mercantile Bank of India, Chandni Chowk Branch, Delhi, which had opened a letter of credit in favor of the exporter in Japan. After the import of the staple fibres, since the same was hypothecated with the bank, it was kept in the bank's godowns and released for sale by the bank.
