Sunil Kumar Sinha, J. These appeals are directed against the judgment dated 14th of February, 1997 passed in Sessions Trial No.199/95 by the Additional Sessions Judge, Sakti, District Bilaspur. By the impugned judgment, the appellants have been convicted and sentenced in following manner with a direction to run the sentences concurrently:-ConvictionSentenceu/Ss. 302/34, IPCImprisonment for life and fine of Rs. 1,000/- with default sentence of R.I. for 6 month.u/Ss. 307/34, IPCR.I. for 5 years and fine of Rs. 500/- with default sentence of R.I. for 3 months. 2. The facts, briefly stated, are as under:- 2.1 Two persons namely Patwari Sahu and Rukmani Bai (husband and wife) died in the incident which took place at about 6.00 a.m. on 19-12-1994. The case of the prosecution is that at about 6.00 a.m. on 19-12-1994, the two deceased persons and their son Kirtan Sahu (P.W. 1) were threshing their paddy crops in their Khaliyan. 1. Challenge in this petition is to the enquiry report dated 23.03.1999 (Annexure P/3), the order of imposition of penalty by the Disciplinary Authority dated 07.05.1999 (Annexure P/5), the order of the appellate authority dated 02.09.1999 (Annexure P/7) whereby the appeal of the petitioner against the imposition of penalty (Annexure P/5) has been affirmed and the charge sheet (Annexure P/13) dated 18.08.1998. 2. The facts, in brief, as projected by the petitioner are that while the petitioner was posted as Officer, Grade III at Bhilai Branch, he was served with a charge sheet on 14.10.1992 (Annexure P/1) under provisions of Rule 50(1)(i) of the State Bank of India (Supervising Staff) Service Rules, 1975 (for short the Rules, 1975) asking the petitioner to submit his response within a period of 15 days.
