This appeal is directed against the judgment of conviction and order of sentence dated 30th August, 2002 passed by the 3rd Additional Sessions Judge (Fast Track Court), Raigarh in Sessions Trial No. 133/2001, whereby & where-under learned Additional Sessions Judge after holding the accused/appellant guilty for commission of offence under Section 302 of the IPC, for committing the murder of Khadbad, sentenced him to undergo imprisonment for life, however, he has been acquitted from charge under Section 201 of the IPC.2. Case of the prosecution, in brief, Is that wife of accused Dayaram started residing with Anjore Singh {son of deceased Khadbad) as his wife and for that reason the accused was having grudge against the family of Khadbad. The petitioner, by this petition, challenges the validity of the order dated 12-1 -2006 (AnnexureP-5), whereby, appointment of the petitioner on the post of Urdu Shiksha Karmi Grade II in Nagar Panchayat, Gorella was cancelled on account of the facts that on scrutiny it was found that the process for selection was not done in accordance with rules. Further, order dated 3-1-2006 (Annexure R-l/7), issued by the respondent No. 3, i.e., Collector, Bilaspur, was also sought to be quashed.2. The indisputable facts, in brief, are that pursuant to the advertisement dated 11-5-05 (Annexure P-l), the petitioner made an application for appointment on the post of Urdu Shiksha Karmi Grade II. ORDER1. The petitioner is the directly elected President of Nagar Panchayat Nawagarh, whereas, respondent Nos. 6 to 17 are the elected Councillors. The strength of the Nagar Panchayat is 15.2. On 11-7-2007 respondent No. 11-Shri Jahid Beg moved an application (Annexure P-2) before respondent No. 2-Collector, Durg for recalling the petitioner from the post of President, Nagar Panchayat, Nawagarh claiming that 11 Other Councillors have also signed the application for recalling the petitioner. Respondent No. 3-Deputy Collector vide memo of Annexure P-3 summoned all the Councillors, who had signed the application of Annexure P-2 on 13-7-2007 in his office.3. No. 2678/88, whereby, their petition filed against the order of cancellation of their appointments was dismissed by the Tribunal.2.
