ORDERFakhruddin, J.1. This Revision has been preferred against the order dated 25-01-2001 passed by the Special Judge, Durg in S.T. No. 22/2001, whereby charge under Section 306/34 of I.P.C. has been framed against the applicants.2. Briefly narrated the facts are that Ku. Beenu Sharma, the girl aged about 19 years was a student of Class XII. She was studying in Saraswathi Higher Secondary School, Kailash Nagar, Bhilai. The applicants are class fellows and were studying in the same Section. Accusations were made against the deceased that she is a thief and has stolen articles. The incident of alleged theft occurred in the class room on 12-08-2000 and 16-08-2000. The suicidal note is there on the record and has been filed at page No. 27 as Annexure A-10. A perusal of the suicidal note prima facie goes to show that name of Usha and Archana are mentioned with reference of the accusations made against the deceased.3. No. 242/2000 whereby the non applicants 1 & 2 have been discharged of the offence punishable under Section 307 of IPC and instead charge under Section 324/34 of IPC has been framed.2. According to the prosecution, while the applicant/complainant going on a bicycle from Pali Markadih, to Janjgir, near the Railway bridge the non applicants 1 & 2 met him on the way and non applicant No. 1 inflicted injuries on the neck, back, right hand, shoulder and on various other parts of his body with a tangia. The appellant has been convicted for the offence punishable under Section 302 of the Indian Penal Code and sentenced to undergo rigorous imprisonment for life coupled with a fine of Rs. 2000/-.2. According to the prosecution the incident occurred on 17-9-99 at about 5.00 p.m. It is alleged that Pohduram was assaulted by means of lathi/danda by the accused Gopi @ Gopal on his head. He was taken to the hospital at about 7.15 p.m. where he was examined by the doctor. The deceased died after five days on 23- 9-99. The post mortem was conducted by Dr. R.K. Singh (P.W. 8). The post mortem report is Ex. P/13. The report of the incident was lodged as per Ex. P/7 for the offence punishable under Sections 323, 341, 506 and 294 I.P.C.
