P.K. Das, J. 1. By Stay Order No. 42008/2013 dated 24.7.2013, the applicant was directed to make a predeposit of Rs.2.50 crores within a period of eight weeks and report compliance on 4.10.2013. The applicant filed an application for modification of the stay order, which was dismissed vide order dated 4.12.2013 but the period of compliance was extended by further six weeks and directed to report compliance on 23.1.2014. The learned counsel submits that they have filed CMA before the Honble Madras High Court against the modification order dated 4.12.2013. It is submitted that the Honble High Court directed the appellant to challenge the stay order also, which they have complied with. The learned counsel submits that the period of 180 days as stipulated under Section 130 of the Customs Act, 1962 for appealing against the modification order dated 4.12.2013 before the Honble High Court has not expired and that the period of compliance may be extended. 2. The learned counsel submits that they filed writ petition before the Honble Madras High Court and the Honble High Court vide order dated 30.10.2013 dismissed the writ petition and directed the appellant to file CMA within a period of three weeks. The learned counsel submits that they have filed CMA and it is yet to be listed. 2. The learned AR on behalf of the Revenue submits that vide Misc.
