(This appeal coming before us for final hearing on 22.07.2013 and on hearing the arguments of the appellant's counsel and upon perusing the material records, this Commission made the following OrderJ J. The case of the complainant is that on 1-10-2008 at about 2 pm the complainant went to the Opposite Party restaurant along with his friend and had their lunch, consisting of Biriyani and Meals. They were sitting in the AC room where AC was not functioning, but it was known in advance that there would be no power supply from 2 pm to 5 pm there and even then there was no generator to meet the emergency.
