ORDERA.K. Rajan, J.1. This revision is against acquittal. 2. The petitioner was the complainant before the lower Court. He preferred a complaint, under Section 420 I.P.C. against the respondent. The complainant is a firm dealing in papers and the accused is the Managing Director of M/s. Sree Royalaseema Paper Mills Limited who appointed the complainant as the dealer of M/s. Sree Royalaseema Paper Mills Limited. The complainant had paid more than Rs.one crore as advance to M/s. Sree Royalaseema Paper Mills Limited. But they received supply only to the value of Rs.36 lakhs. In July, 1989, the General Manager (Marketing) of M/s. Sree Royalaseema Paper Mills, Mr. Kamesan came to the office of the complainant at Madras and represented that they would supply 300 tonnes of paper by August, 1989. Prabha Sridevan, J.1. One Alagiriswami Naidu filed O.S.No.424 of 1974 for recovery of money against Thangavel, the second respondent herein now deceased. The first respondent represented by his mother Nallammal the 17th respondent filed an application under O.21, R.58, CPC in the execution proceedings of the decree in that suit. The suit properties in that execution application and the suit properties in the present appeal are the same. The present appeal is the continuation of a later suit O.S.No.69 of 1983, which is a suit filed by the first respondent as a minor represented by his mother against his father 'T' for declaration of his and his brother's share and other reliefs. A.K. Rajan, J.1. This appeal is against the acquittal.2. The case of the prosecution is that Appu Hotels Limited, Chennai, was the owner of the lands situate at door No. 1, West Cott Road, Royapettah, in an extent of ten grounds and 1,267 square feet; they purchased the property on April 15, 1987, for a sum of Rs. 50 lakhs. The third respondent, Sunil Estates, which is a partnership firm, entered into an agreement to put up construction in the property and thereafter, take 50 per cent of the constructed area and adjust for the amount invested by the third respondent. While that be so, the ground over the constructed area also could be sold by the third respondent. This amounts to transfer of ownership with respect to 50 per cent of the immovable property, as per Chapter XX-C of the Income-tax Act, 1961.
