Facts of the case giving rise to this appeal are somewhat unusual in the sense that a church is aid to be in existence at No. 22, Rangarajapuram, Nagarjuna Nagar 2nd street, Kodambakkam, Madras-24, but, according to the plaintiffs/appellants, it, 'was formed by Pastor G. Sam Daniel, in the year 1969', a Christian by birth and who turned to pantecost subsequently, and according to the defendants/respondents, who have entered appearance and contested the interlocutory applications, the first respondent, Sadhu Jesudasan, who is a born Christian and has renounced the worldly life, started prayer houses by putting up small thatched sheds at several places, 'established a prayer house at Arcot Road, kodambakkam, Madras, in the year 1969. After some time, the vacant site at No. 22, Nagarjuna Nagar 2nd Street, Rangarajapuram, Kodambakkam, Madras-24, was taken on lease. This writ petition is for quashing the order of the respondent dated 20.8.1992 and to direct the respondent to consider the renewal application of the petitioner for renewal as per the provisions of Rule 9 of the Tamil Nadu Minor Mineral Concession Rules (hereinafter referred to as the Rules).2. The petitioner is the manufacturer of crusher jelly which can be used for building construction and road making purposes, The respondent herein by proceedings dated 5.1.1973 has granted mining lease for quarrying jelly for ten years. The quarry is at Melur village, Kulathur taluk and the extent is 11.91 acres. The petitioner applied for renewal of lease by application dated 3.5.1982. The respondent by proceedings dated 16.11.1982 renewed the mining lease for a further period of five years from fasli years 1392 to 1396.
