ORDERMishra, J.1. The defendant in a proceeding under S. 20 of the Arbitration Act has come in appeal against an order setting put the dispute between the parties and referring the same to the sole arbitration of a retiredjudge of this Court, The case in brief of the plaintiff-respondent has been that in pursuance of the notice inviting tenders issued by the defendant-appellant for the work of construction of marriage accommodation for MCPOS/CPOS/POS and junior sailors at Arakkonam, it submitted tender for the said work. The defendant by its letter dated 11-8-1988 accepted the same for a lump sum of Rs. 7,54,03,216/-. During the course of execution of the work, the defendant, according to the plaintiff, acted in a way which was totally opposed to the terms of the contract. The contract period had to be extended due to reasons beyond the control of the plaintiff. Defendant granted extensions from time to time. ORDERA.R. Lakshmanan, J.1. These two revisions can be dealt with together, as both of them arise from the same order dated 9.9.1992 in O.S. No. 68 of 1948 as amended in O.S. No. 17 of 1960 of the (Scheme Court), Subordinate Judge, Mayiladuthurai. Brief history of the case is as follows:A.V. Charities, Mayiladuthurai, is a Trust which is governed by a Scheme Decree made in O.S. No. 68 of 1948 dated 24.7.1951 on the file of Sub Court, Mayavaram as amended in O.S. No. 17 of 1960 on the file of the same court. As per the said Scheme Decree, the Management of the Trust vests in a Board of Trustees consisting of a Chairman and five Trustees to be appointed by the Scheme Court from among the members of the original five families that gave the original endowment. The five families that gave the original endowment are: (1) Anbanathapuram family, (2) Enathimangalam family, (3) Pallavarayapet family, (4) Karugudi family, and (5) Kanganamputhur family.
