M.M. Ismail, C.J.1. This is an appeal against the Judgment of V. Ramaswami, J., dated 17th December, 1979, dismissing Writ Petition No. 6083 of 1979 filed by the appellant herein. As the order of the learned Judge itself points out, the only point that was urged before him was whether incentive wages formed part of 'wages' as defined in the Payment of Gratuity Act, 1972. The definition of the term 'wages' as contained in S. 2(s) of the Payment of Gratuity Act, 1972, reads as follows : 'Wages' means all emoluments which are earned by an employee while on duty or on leave in accordance with the terms and conditions of his employment and which are paid or are payable to him in cash and includes dearness allowance, but does not include any bonus, commission, house rent allowance, overtime wages and any other allowance'. This Civil Revision Petition is at the instance of the Kumbakonam Municipal Council questioning the correctness of the order of the Court below dismissing an application filed by it under Order 34, Rule 5, Code of Civil Procedure, on the ground that the petition is barred by time. The petitioner instituted O.S. No. 446 of 1973, District Munsif's Court, Kumbakonam, for the recovery of arrears of property tax. According to the petitioner, a house in Pothamarai South Street, Kumbakonam town, belongs to the respondent and has also been assessed in her name. Ramanujam, J.1. This appeal arises out of an award passed by the Motor Accidents Claims Tribunal, Madurai, in M. A. C. O. P. No. 160 of 1971 on its file.2. On 2nd December, 1970 at about 3. 45 P. M. one Naina Mohammed was going in his motor cycle, M. D. A. 7826 from east to west in Tamil Sangam Road, Madurai Town, with three boys on the pillion of the motor cycle. At that stage, the Madras Fire Service Ambulance van, M. S. M. 2103 driven by one Diraviam Paul and owned by the State of Tamil Nadu through the Director of Fire Services, came in the opposite direction and it hit against the motor cycle violently, with the result all the riders in the motor cycle were thrown away resulting in serious injuries. The property bearing door No. 206, Arcot Road, Vada Palani, Kodambakkam, Madras belonged to the family of the appellant and respondents 1 and 2 in execution of the decree obtained by them in O. S. No. 6757 of 1975, brought the property to sale in E. P. No. 2336 of 1976 and the third respondent purchased the property in the sale held on 22nd November, 1978, for a sum of Rs. 56,250. ORDERM.M. Ismail, C.J.1. These are appeals against the order of Mohan, J , dated 7th March, 1980 dismissing Writ Petitions Nos. 1092 and 1093 of 1980 filed by the appellants herein. It is admitted that the facts are identical and therefore, it is enough if we refer to the facts in W P No. 1092 of 1980. On 2nd October, 962, that is the notified date of the Tamil Nadu Land Reforms (Fixation of Ceiling on Land) Act, 1961, the appellant had 15 standard acres, this did not include 3.631/2 acres, which were pending adjudication before the Minor Inams Tribunal, inasmuch as the inam had been notified under Tamil Nadu Act XXX of 1963.
