ORDERMack, J.1. All these petitioners have been convicted cinder Section 7 (1) (a) and (b), Criminal Law Amendment Act, 1932, by the learned Third and Seventh Presidency Magistrates. They have all been tried in pairs and sentenced to six months' rigorous imprisonment, except petitioners in Cri. B. O. Nos. 442 and 489 of 1951 who have been sentenced to three months' rigorous imprisonment, The case against them is that on dates between 10th March 1951 and 4th April 1961 they went in pairs near the shop of Kishinchand Chellaram in Mount Road with placards and black flags and sought to dissuade intending customers from purchasing in this North Indian shop,2. 1. Petitioner, a student aged 20, has applied under S. 491, Criminal P. G. to recover the custody of the wife, Padmavathi Animal, aged 17, by the issue of a writ of habeas corpus, alleging that she was illegally and improperly detain-ed by her mother, respondent 1 and her brothers, respondents 2 and 3. I am very doubtful as to the admissibility of this petition which I was inclined to dismiss in limine but for reliance placed on the Bench decision Subbaswami Goundan v. Mack, J.1. Ramaswami alias Kuppuswami, aged 27, has been found guilty under Section 302, I.P.C., of the murder of Subramania Mudali, whom he is alleged to have shot through the head with a revolver in the course of a high-way robbery on the Katpadi Gudiyattam High Road at about 7-40 p.m., on the 21st of August 1950. Muniyandi, the 2nd accused, who is also said to have carried a -Revolver in this robbery has been found guilty under Section 302, read with Section 34, I.P.C. The learned Sessions Judge has sentenced them both to death. Two others (accused 3 and 4), who were also charged under Section 302, I.P.C., read with Section 34, I.P.C., have been acquitted.2. The deceased Subramania Mudali was a handloom cloth trader of Gudiyattam who was returning in a bandy driven by his cousin Natarajan (P.W. 2), a lad of 16.
