The applicant claims to be an ex-casual Labour and claims that his name was listed in the live register as he had completed more than 120 days of working. His grievance is that he has not been given employment by operating the live register. He has also stated in the O. A. that he was sent for medical examination and he has passed the prescribed medical test on 1.12.86. He has produced the copy of the medical certificate issued by the Railway Medical Officer on dated 1.12.1986 at Annexure-O. He contends that the department has already assessed about 37 vacancies of Khalasi/Gangman in category 'D'. Petitioners of all these petitions are employees of the Postal Department and since all these petitions are directed against the action of the respondents in withdrawing or reducing the incentives given to them, all the petitions are heard together and are being decided by this common judgment.
