The case of the complainant in brief is that the complainant is S.B. account holder of opposite party No.1 and availed cheque facility and also provided with ATM card bearing No.5044352010700019561 valid from October, 2005. He submitted that he was drawing money through ATM card and opposite party No.1 debited an amount of Rs.5,000/- towards reversing the entry of ATM O.D. dated 03-3-2006 which was noticed by the complainant in May, 2006. Immediately he gave a representation dated 25-5-2006 that he never withdrew the amount on 03-3-2006 and also submitted the ATM slips and mini statements and requested to reimburse the said amount but there was no response. The case of the complainant in brief is that he applied for allotment of a duplex house by virtue of a notification issued by Respondents-Board. As against Rs.16,16,000/- he paid Rs.10,000/- towards application fee which was construed as deposit. Later he paid an amount of Rs.2,16,600/- on 20-8-2005. He also obtained loan of Rs.14,00,000/- for the balance amount from the bank. Oral Order ( per Honble Justice Sri D.Appa Rao, President.) Heard both sides. This is an appeal preferred by the complainant against the dismissal of its complaint for default. The complainant preferred this appeal alleging that on the said day, its counsel was held up in traffic jam and could not attend the Forum when the matter was called and consequently the complaint was dismissed for default. Evidently, the District Forum has no jurisdiction to set aside the order of default. Considering the fact that the learned counsel could not attend the Forum in view of traffic jam, we are of the opinion that an opportunity be given to prosecute its case, however, in view of latches on payment of costs of Rs.200/-.
