While so on 24.11.2002 at about 8.30 p.m. while he was returning from his duty on his scooter an unknown vehicle dashed against him due to which he fell down, sustained multiple injuries and died on spot. The facts of the case stated briefly are as follows: The complainants are the wife and son of the insured by name, K.Sambasiva Rao, who died as a consequence of an accident on 9-8-2002 while the insurance obtained by him by way of Personal Janata Accident Policy was valid from 31-3-1999 to 30-3-2011. The said death was intimated to the opposite party, insurer. The opposite party repudiated the policy saying that the said policy was cancelled as per notice dated 14-2-2002.
