A. Gopal Reddy, J.1. Appellants (Al and A2), who are mother-in-law and husband of the deceased-Alugubilli' Kavitha, were tried for the offence under Sections 304-B, 302 r/w 34 IPC and Sections 3 and 4 of Dowry Prohibition Act, 1961 (for short 'the Act') in SC No. 522 of 2005 by the Vth Additional District and Sessions Judge (III Fact Track Court), Nalgonda at Mirayalaguda. The learned Sessions Judge found Al guilty for the offence under Section 304-B IPC and Section 4 of the Act, accordingly convicted her for the said offence and sentenced to undergo imprisonment for life and also rigorous imprisonment for one year with fine of Rs. 5,000/- each, in default to suffer simple imprisonment for one year and six months respectively. This is an appeal preferred by the Electricity Board aggrieved by the order of the District Consumer Forum-II, Tirupati, in directing it to pay Rs. 45,000 towards damages and Rs. 1,000 towards costs. 2. The case of the complainant in brief is that he was a small farmer. He installed 5 HP tube well electric connection under service No. 44 in his field. He raised sugarcane crop by utilizing power for irrigating his land, through which a 11 KV electric line was passing. While so, on 16.10.2006 at about 2.00 p.m. a live wire was cut and fell on his agricultural field. The entire crop was burnt. Immediately on information the officials of the Electricity Board came and restored the line. On report, the Fire Station Officer had extinguished the fire. In all he had sustained a damage of Rs. 90,000 towards loss of crop.
