The brief facts as set out in the case are that since the complainants daughter Ms. Madhavi aged about 15 years was suffering from throat pain, the complainant took her to opposite party No. 1 doctor on 10.6.1996 and on examination, opposite party No. 1 doctor prescribed some medicines stating that the patient was suffering from tonsils. Raja Rao who took LIC policies among other policies for an assured sum of Rs. 7,00,000 from the first opposite party on 28.7.2000 paying a premium amount of Rs. 38,137 and the first complainant is the nominee of the policy holder. The complainants submit that by the date of policy, the policy holder was hale and hearty and the policy was issued only after thorough medical examination by the panel doctor.
