No. 397 of 1998, on the file of the Motor Accidents Claims Tribunal-cum-Additional District Judge, Ananthapur, filed this appeal, under Section 173 of the Motor Vehicles Act (for short 'the Act').2. On 25-9-1996, when the son of the appellant herein, by name T. Ramakrishna, was travelling in an auto bearing No. AHT-9148, owned by the 1st respondent and insured with the 2nd respondent, along with two other passengers, for the purpose of going to Gooty, an unidentified lorry came and hit the auto. Due to the hit, the auto fell on the left side of the road. The son of the appellant and two other passengers died, on the spot.
