ORDERS.B. Sinha, CJ1. This writ petition has been filed by the wife of K. Srinivasan since deceased claiming pensionary benefits. The petitioner's husband joined as casual labourer and worked in that capacity in the construction wing from 1-1-1956 to 31-3-1973. He was appointed as regular lascar from 1-4-1973 and retired on 31-7-1978. He was not given any pensionary benefits. He filed OA No.1230 of 1998 before the Central Administrative Tribunal. During pendency of the said application he died on 29-3-1999 and the petitioner herein was substituted in his place. The learned Tribunal in the impugned order dated 27-9-1999 rejected the submission of the petitioner herein in the following terms:'7. ..... ORDERS.B. Sinha, CJ1. The 1st respondent herein was appointed as sewing and tailoring instructor in Panchayat Raj Department on payment of a consolidated sum of Rs.300/- pm. She was retrenched. She thereafter made a representation to the District Collector, Cuddapah and although the District Collector was not an appointing authority he directed the Regional Deputy Director of Women and Child Welfare, Kurnool to allot her in any one of the vacant posts of organizers in Cuddapah district inthe District Women and Child Welfare Office as instructor in sewing and tailoring. Despite the same she had not been absorbed as organiser. Thereafter the 1st respondent filed the original application before the learned Tribunal being numbered as 1292 of 1994. The basic fact of the matter is not in dispute. The petitioner was appointed as Junior Assistant in Pothukatla Gram Panchayat. His services have been regularised by the District Panchayat Officer, Ongole by a proceeding dated 19-5-1984 with effect from 6-7-1981. He was put on probation and said to have been successfully completed his period of probation w.e.f. 5-7-1983. At his request, by proceedings of the Collector dated 6-2-1989 he was transferred to the Unit of the District Panchayat Officer. The question which arises for consideration in this writ application is as to whether the test required to be passed for holding the post of foreman is a technical qualification or not. The petitioner was promoted as foreman on 15-6-1992 subject to the condition that he should pass Sericulture departmental test within the prescribed period. As he failed to pass the said test he was reverted by proceedings in RC No.732/99-B, dated 9-6-1999 whereafter he filed the original application before the learned Tribunal the judgment whereof is under challenge before this Court. Abdul Hameed on 23-11-1999. He preferred an appeal there-against which was disposed of by one Mr. S.N. Tiwari, Additional Commissioner, (P&A;) by an order dated 16-6-2000.
