ORDERS. Parvatha Rao, J.1. The petitioners who are in the feeder posts and are eligible for consideration for appointment to the posts in Category-2 in Division-4 under Rule 6 of the A.P. Ministerial Service Rules, 1964, ('Rules' for short), seek a declaration that the action of the respondents in calling them for written examination scheduled to be held on 16th and 17th of November, 1996 for the purpose of promotion to the said Category-2 posts, is illegal, arbitrary and unconstitutional and seek a writ of mandamus to that effect.2. The question raised in this writ petition turns on whether the appointment to the said Category-2 posts are merely on the basis of seniority or whether ability also has to be taken into reckoning. ORDERP. Venkata Rama Reddy, J.1. This writ petition is filed by merchants of Tuni, East Godavari District, who deal incashew-nuts. They question the action of the forest officials in insisting upon transport permits for movement of cashew-nuts purchased by the petitioners in the areas surrounding Narsipatnam, K. D. Peta, Anaka-palli and Bhimunipatnam. The petitioners allege that the 3rd respondent and his subordinates are not allowing the transport of cashew-nuts purchased by them from the ryots owning private lands and from market yards. However, as far as the movement from market yard is concerned, no specific relief has been sought for and no arguments have been addressed to us in this behalf.2. The petitioner, who is a senior Air-Craft Engineer in the service of the Indian Airlines, has filed this writ petition assailing the order dated 17-2-1994 passed by the second respondent cancelling the Air-Craft Maintenance Engineer Licence of the petitioner. The impugned order dated 17-2-1994 came to be passed under the following circumstances.2. A Boeing Aircraft of the Indian Airlines operating from Nagpur to Delhi was involved in an incident on 31-10-1993. During take off from Nagpur, its left hand Main Landing Gear outboard wheel (No. 1 main wheel) came out of its axle. The Aircraft continued its flight to Delhi. District Judge, Kurnool, dissatisfied with the compensation awarded by the Tribunal, preferred this appeal.2. The appellant, aged about 27 years was eking out his livelihood as a labourer and Hamali earning about Rs. 25/- per day. On 25-1-88 at about 5.30 p.m., the tractor AAQ 5260 and trailer 5261 were in the auto garage of one Satyanarayana at Adoni. The tractor was under repairs since sometime separately in the garage. While the appellant was loading some bags into the trailer, the driver reversed the tractor towards the trailer without observing the persons working around and without giving proper precautions to the workers and consequently the appellant, who was loading the trailer, was crushed between the trailer and the tractor.
