ORDERY.V. Narayana, J.1. This revision petition is filed by the plaintiffs in the suit O.S. No. 1392 of 1984 on the file of the III Addl. Judge, City Civil Court, Secunderabad against the order dated 4-11-1994 passed in LA. No. 2094 of 1994..2. The brief facts of the case are: The plaintiffs filed the suit for perpetual injunction claiming rights in respect of 250 sq. yards of site in S.Nos.203 and 204 in Lalaguda, Secunderabad. The defendant filed a suit O.S. No. 1612 of 1985 for declaration and possession of 500 sq. yards in S. No. 207/2 of Lalaguda. S. Sayanna and anr. Vs. P. Sudersan

Court: Andhra Pradesh

Decided on: Jul-11-1995

Reported in: 1995(2)ALT512

ORDERY.V. Narayana, J.1. Assailing the order of the learned VII Asst. Judge, City Civil Court, Hyderabad dated 12-6-1995 made in I.A. No. 112 of 1995 in O.S. No. 2425 of 1994, the plaintiffs-petitioners filed the present revision.2. The facts of the case are: The plaintiffs originally filed I.A. No. 508 of 1994 seeking interim injunction against the respondent-defendant. Initially temporary injunction was granted which was made absolute subsequently. When the matter was carried to the appellate Court, the appellate Court confirmed the orders of the trial Court. Thus the plaintiffs were in possession and enjoyment of the suit property. The defendant started creating obstructions and trying to interfere with the possession of the plaintiffs, in spite of the injunction order. On 7-2-95 the defendant locked the premises of the plaintiffs. Then the plaintiffs went to the Police Station and lodged complaint. Knowing this the defendant removed the lock and ran away. Thus the defendant has dis...

No. 2180 of 1994 in O.S. No. 389 of 1993, dt.6-2-1995. The learned Additional Judge has rejected the request of the petitioners to direct the respondent to supply the copies of documents, on the ground that the petitioners have already taken three adjournments for filing the written statement and they have not denied the contention of the respondent that the petitioners got knowledge about the documents filed by the respondent-Bank and the 2nd petitioner had already taken one set of loan amounts executed by him.2. I have heard both the Counsel at length. Learned Counsel appearing for the petitioners contended that the lower Court ought not have dismissed the application to supply the copies of documents in the plaint, to the petitioners. ORDER1. Petitioner seeks a direction to the 6th respondent -- the 1st Additional Judge, City Civil Court, Hyderabad to register the plaint O.S.S.R, No. 5477 of 1995 without insisting production of market value certificate from the registering authority for the purpose of payment of proper court-fee at the time of presenting the plaint.2. The petitioner raises an important question before this Court that as per Rule 3 of A. P. Court-fee and Suits Valuation Rules, 1987 (for short 'the Court-fee Rules'), insistence of market value certificate to be obtained from the local registering authority for the purpose of payment of proper court-fee at the time of presenting the suit in the Court, is causing lot of hardship to the parties who approach the Courts for obtaining necessary relief in time in the suits being filed by them.3. It is the case of the petitioner that she presented a suit before the 1st Additional Judge, City Civil Court, Hyderabad which is numbered as O.S. S.R. No. 5477/95. T...
