ORDERS. Parvatha Rao, J.1. Heard the learned Counsel for the petitioner and the learned Government Pleader for Forests.2. The petitioner questions the proceedings bearing Rc.No.3846/93/S3, dated 21-2-1994 of the 2nd respondent herein i.e., the Divisional Forest Officer, Khammam, cancelling the sale of Cashew usufructs for 1994 season of 1964 Rajerla plantation which was confirmed for Rs. 31,700/- in favour of the petitioner on the ground that he violated sale condition No. 13(ii), and forfeiting the amount paid towards 1/4th sale amount. In the said proceedings, it is also stated that the 1st respondent herein i.e., the Conservator of Forests, Khammam also ordered to cancel the said sale in his Rc.No.112/94/M4, dated 7-2-1994.3. One Ms. Seethadevi, Deputy Commissioner, Commercial Taxes was kept in full additional charge of the post of Joint Commissioner, Commercial Taxes, by an order dated September 15, 1989 and with effect from that date she functioned in the capacity of Joint Commissioner till January 21, 1990. In exercise of her statutory power as Joint Commissioner, by an order dated October 23, 1989, she revised an order passed by the Deputy Commissioner. Challenging the revisional order passed by her the petitioner herein, a registered dealer under the Andhra Pradesh General Sales Tax Act, filed an appeal before the Sales Tax Appellate Tribunal which by its order dated June 28, 1993, dismissed the appeal holding that Ms. Seethadevi during the period when she held full additional charge of the post of Joint Commissioner was fully competent to exercise revisional jurisdiction under the Andhra Pradesh General Sales Tax Act. Syed Shah Mohammed Quadri, J.1. The petitioner is the manufacturer of beer and a dealer within the meaning of the A.P. General Sales Tax Act, 1957 (for short 'the Act'). An order of assessment was passed by the Commercial Tax Officer on April 20, 1993. He preferred an appeal against that order of assessment before the Appellate Deputy Commissioner, Guntur. By order dated May 6, 1993, the appeal of the petitioner was allowed by the appellate authority. ORDER1. This is a public interest litigation brought in by Sri N. Prasanna Kumar Reddy, a member of the A.P. Legislative Assembly seeking for issue of habeas corpus directing the State to forthwith set at liberty the undertrial prisoners in the State of A.P. the particulars of which are furnished in Annexures A-1 to A-4, the reports published in Udayam a telugu daily newspaper. The petitioner both as a citizen and as a public servant is concerned about the human tragedy and misery of unfortunate persons who are languishing in prison for the past several years. They exceed more than 6000 unfortunate helpless innocent poor people. These undertrial prisoners have already undergone imprisonment which is more than the maximum punishment that a law Court can inflict upon them any further detention these people in prisons is utterly unconstitutional, devoid of legality, totally unjustifiable, constitutionally immoral, statutorily indefensible and highly barbarous.
