ORDERP. Venkatarama Reddy, J.1. The Award of the Labour Court, Hyderabad dated February 17, 1987 in I.D. No. 46 of 1981 is being challenged in this writ petition. The petitioner was an employee of the second respondent company before he was dismissed from service on January 7, 1977. At that time he was working as departmental Supervisor in-charge of material warehouse, having been promoted to that post on July 16, 1976 on probation for a period of one year. Earlier he was working as Head Clerk. The allegation against him was that when he was the Factory Head Clerk, there was an excess issue of huge quantity of cigarettes and that this loss had occurred on account of the dereliction of duties on the part of the petitioner in not checking up the records properly. N.D. Patnaik, J.1. One person by name G. Ramulu had taken on lease a shop bearing No. 3-3- 418/1 belonging to Sri Narsing Temple and Mutt, Mahankali Street, Secunderabad from 1-10-1975. The tenancy was not evidenced by any document and it is only a month to month tenancy. After taking the shop on lease, G. Ramulu entered into partnership with another person by name Jagadeshwara Rao to carry on business in the said shop. But as per the terms of the partnership deed, Ramulu continued to be the lessee of the shop. Ramulu died on 21-12-1981. ORDER1. The petitioner herein joined service as servant and was promoted as Conductor in the transport wing of Tirumala Tirupati Devasthanam (for short 'TTD'), Tirupathi. The said transport undertaking was taken over by the Andhra Pradesh State Road Transport Corporation (for short 'APSRTC') in pursuance of the agreement date August 8, 1975. The Depot Manager, A.P.S.R.T.C. at Tirumala passed an order on July 4, 1988 suspending the petitioner pending enquiry. The said order of suspension was challenged in W.P. The Writ Petitioner is a Transport Operator and seeks for issuance of a Writ of Mandamus declaring the proceedings dated 1-7-1992 of the Regional Transport Authority, Guntur the first respondent herein, rejecting the application for the grant of variation of the route seeking extension of the existing town service route of Guntur-Nallapadu to Perecherla junction as illegal and void. From a perusal of the impugned order, it is evident that the existing permit for the route covering 7 kilometres from Guntur-Nallapadu was granted to the Petitioner on 19-6-1990 and the variation sought for was 5 kilometres making the total distance to 12 kilometres.
